The Reparation for Damages Caused by the Offending Party and the Civil Liability Ex Delicto of the Institution to which he Belongs

This article analyzes the Italian jurisprudence concerning the civil liability of ecclesiastical entities, with particular regard to reparation for damages deriving from patrimonial delicts committed by clerics or religious. The contribution also highlights the critical issues regarding the recourse that the ecclesiastical body should exercise – against the cleric or religious who is the direct author of the damage – before the state’s jurisdiction or in the canonical forum.
