Error of law on the bonum coniugum. Its systematic positioning and potential invalidating role in the canonical matrimonial system

Abstract

In cc. 1096 and 1099 there is no reference to the bonum coniugum; therefore, it seems that an error about this marital good cannot have any invalidating effect. This article aims to rethink this issue in the light of natural law, from a doctrinal and jurisprudential perspective. Our conclusion is that the ordinatio ad bonum coniugum as an essential element of marriage, like the ordinatio ad bonum prolis, is part of the minimum knowledge required to marry.
