The promotion of the proximity and of the decentralization of the competences of the episcopal conferences

This contribution examines the modifications of the Code of Canon Law regarding the competences of the episcopal conferences according to the m.p. Competentias quasdam decernere (artt. 1, 2, 8). The main intention of the new legislative order is to promote the proximity and decentralization in emanating decisions. The nature of the decision reserved to the Apostolic See regarding the erection of an interdiocesan seminary and its statutes, the Ratio of priestly formation, and the publication of the proper catechism is not an approbatio anymore, but only a confirmatio. The legislative modification, however, demands an adequate hermeneutical and operative development.
