Application Of Criminal Sanction And True Equity: Canonical Observations About The «Due Trial»

Abstract

The article analyses the canon legislation regarding the criminal trial and the criminal administrative procedure, in order to verify if these lawsuits can be view as «due». The comparison parameter is international legislation, especially the European Convention of Human Rights. The result of the analysis is highly positive, but some flaws, as regards the administrative procedure, have been recognized.
