Abstract

It is a common opinion that parents are the first educators of their children.mIn this article we study homeschooling in general and in legal aspects. It is not only a pedagogical option but a critical minority trend that implies a family lifestyle. There are many issues that raises from the moment that it is proposed as an alternative to public school, that is, to the master State with its claims of neutrality increasingly ideological. It is a question of freedom, often religious, that finds acceptance in the countries of Anglo-Saxon culture and others where the State does not encamp the protagonism of social life. As we move away from subsidiarity education is increasingly identified with schooling, and the responsibility to guarantee everyone the right to study confused with the management of it right, even against parental choices. Some judicial decisions are studied in this regard.
