Abstract

The article explores the possibility of reconciling Eastern legal traditions with the idea of a «Modern Code». The adaptability of the technique of the codification to oriental discipline depends on several factors, first of all the implicit philosophical-juridical assumptions of the codification and its elasticity. In addition, the author asks how to reconcile the idea of a «Unique Code» for all Eastern Churches with the variety characterizing the disciplinary heritage of the Orient? Lastly, the author proposes a critical evaluation of the oriental canonical specificity of the CCEO’90.
