The Juridical-Canonical Problem of Marriage and Family from the Perspective of Justice and Mercy: Foundational Aspects

In this article, the juridical-canonical problem of marriage and family is focused in a different way. The centrality is not more attributed to the normative and procedural system, but to the dimension of justice inherent in marriage and family as ecclesial juridical goods, to whose service that system is placed. At the same time, the article shows the harmony between mercy and justice, the importance of mercy for the recognition and protection of rights in the Church, and the need to always keep account of divine law in the application of canon law to individual cases.
