This article studies the magisterium and praxis about the dissolution of the non-sacramental and consummated marriage by the exercise of the power of the Roman Pontiff, from the Code of 1917 to the Norms of 2001. The period after the CIC 17 has been chosen because it is a key moment in the development of this power. It goes deeper into this exception to the indissolubility of all marriages to seek, in the praxis and normative object of study, the foundation that is given to the power of the Roman Pontiff to dissolve.
