Abstract

Canon 1405 § 1 reserves to the judgment of the Roman Pontiff not only the cases of Cardinals, Legates of the Apostolic See and bishops (in penal cases), but also the cases of Heads of State. The article analyses the meaning and the ratio of this disposition by a comparative study with the respective canon of the abrogated Code of Canon Law.
